INFORMATION ABOUT PERSONAL DATA PROCESSING ACCORDING TO SECTION 15 OF THE PERSONAL DATA PROTECTION ACT

Whereas:

  1. the company J&T REAL ESTATE, a. s., with its registered office at Dvořákovo nábrežie 10, 811 02 Bratislava, Registration No.: 35 712 155, registered with the Companies Register of the Bratislava I District Court, section: Sro, insert No.: 1352/B (hereinafter referred to as “J&T REAL ESTATE”), provides intermediation, business consultancy in the area of sales support and administration, marketing support and other business activities, thus meeting the definition of a controller according to Section 8 of Act No. 122/2013 Coll. on Personal Data Protection, as amended (hereinafter referred to as “the Personal Data Protection Act”);
     
  2. J&T REAL ESTATE operates the web site www.jtre.sk;

J&T REAL ESTATE hereby informs the data subject about the processing of personal data according to Section 15 of the Personal Data Protection Act:

  1. Controller's identification data:

The controller is the company J&T REAL ESTATE, a.s., with its registered office at Dvořákovo nábrežie 10, 811 02 Bratislava, Registration No.: 35 712 155, registered with the Companies Register of the Bratislava I District Court, section: Sro, insert No.: 1352/B.

  1. The purpose of personal data processing:

The purpose of personal data processing is the provision of high-quality commercial-information services, in particular, securing of informing the data subjects about the real estate available for sale, supply of the required information and details about the particular offer or response to the questions of the data subject. The purpose of personal data processing is subsequent marketing activity performed by means of direct marketing, in particular, direct mail, addressed offering and the like.

      3.  List of personal data and their extent:

  1. first name and surname;
  2. e-mail address;
  3. phone number.

      4.   Instruction about optionality or obligation to provide the required personal data:

The processor J&T REAL ESTATE obtains personal data with consent of the data subject based on the completion of a registration form on the web site and sending off the registration form to the administrator of the web site (J&T REAL ESTATE). Upon the registration, the data subject shall complete its first name, surname, e-mail address and phone number. Only e-mail address is compulsory information; J&T REAL ESTATE will send any information or answers to questions to the entered e-mail address. If the provided data cannot be deemed personal data in their entirety (they cannot be assigned to the particular individual), J&T REAL ESTATE records them for the purposes of direct marketing on an anonymous basis.

  1. Third parties or a circle of third parties to whom the personal data will be provided or disclosed. The forms of publication of personal data. Transmission of personal data to third countries:

Personal data are not provide or disclosed to third parties, with the exception of the obligations following from special laws. Personal data are not subject to publication. Personal data will not be transmitted to third countries.

  1. Instruction about the rights of the data subject:

According to the Personal Data Protection Act, a data subject has the rights in the extent defined in Sections 28 through 30 of the Personal Data Protection Act. According to Section 28 of the Act, upon a written application the data subject shall be entitled to request from the controller:

  1. confirmation whether personal data of the data subject are being processed or not;
  2. information about the state of processing of personal data in the information system in a generally intelligible form and in the extent according to the Personal Data Protection Act; if a decision according to Section 28 (5) of the Personal Data Protection Act is issued, the data subject shall be entitled to familiarize itself with the procedure of the processing and evaluating of operations;
  3. exact information, in a generally intelligible form, about the source from which the controller obtained personal data of the data subject for their processing;
  4. list of personal data of the data subject, in a generally intelligible form, which constitute the subject of the processing;
  5. rectification or erasure of inaccurate, incomplete or not updated personal data which constitute the subject of the processing;
  6. erasure of personal data, if the purpose of their processing is fulfilled; if any official documents containing personal data constitute the subject of the processing, the data subject may request return of such official documents;
  7. erasure of personal data which constitute the subject of processing if there is violated the Personal Data Protection Act;
  8. blocking of personal data due to the revocation of the consent before its expiry date if the controller processes the data based on the consent of the data subject.

On the basis of a written application, the data subject shall object to the processing of personal data about which it is assumed that they are or will be processed for the purposes of direct marketing without consent of the data subject and the data subject shall request erasure of such personal data; the data subject shall object to the use of the personal data in the extent of first name, surname, title, and address for the purposes of direct marketing in the mail contact, and also to the provision of personal data in the same extent for the purposes of direct marketing.

On the basis of a written request or in person if the matter cannot be postponed, the data subject shall object to the personal data processing in the cases referred to in Section 10 (3) (a), (e), (f) or (g) of the Personal Data Protection Act, namely by stating the legitimate reasons or by submitting evidence about unauthorized interference with the data subject's rights and legitimate interests that are or can be damaged by such processing of personal data in the particular case; if legitimate reasons do not prevent it and if it proves that the objection of the data subject is justified, the controller shall be obliged to block the personal data, the processing of which was objected by the data subject, without undue delay and erase them as soon as possible.

On the basis of a written request or in person if the matter cannot be postponed, the data subject shall anytime object to and refuse to submit itself to the controller's decision which would produce legal effects on the data subject or significantly affect the data subject, provided that such a decision is issued solely on the basis of acts of the automatic processing of the data subject's personal data. The data subject shall be entitled to ask the controller for the examination of the issued decision by a method other than the automatic form of processing; and the controller shall be obliged to satisfy the request of the data subject, namely in such a manner that the entitled person shall have a decisive role in the examination of the decision; the controller shall inform the data subject about the manner of examination and the outcome of findings with the deadline of 30 days following the day of delivery of the request.

The data subject may file with the Office for Personal Data Protection of the Slovak Republic a motion for the commencement of the proceedings regarding personal data protection if the data subject has a suspicion that its personal data are being processed unlawfully.

If the data subject does not enjoy full legal capacity, its rights according to the Act may be exercised by its legal representative. The rights of a deceased data subject according to the Act can be exercised by the data subject's close person.

 

PRIVACY POLICY

1. Who is responsible for the protection of your personal data?

J&T REAL ESTATE, a. s., with registered office at Dvořákovo nábrežie 10, 811 02 Bratislava, Registration No.: 35 712 155, registered with the Companies Register of the Bratislava I District Court, section: Sa, insert No.: 1352/B (hereinafter referred to as “J&T REAL ESTATE”) is processing personal data and administers this web site in compliance with Act No. 122/2013 Coll. on Personal Data Protection. J&T REAL ESTATE undertakes to accept full liability for the protection of your personal data. 2. What data do we collect?

All our activities are based on strict ethical principles and we undertake to protect the privacy of all visitors to web sites. Therefore, the way in which we collect and store information depends on the way of use of our web sites and related services.

2.1. Data collected by means of interaction with us

Our web sites can use various technologies aimed at their improvement, making them more user-friendly, more practical and safe. These technologies may lead to an automatic data collection on our part or by third parties that provide us services in the area of information technology. These technologies include, for instance, cookies, Flash cookies and web analytics tools.

2.1.1. Click-stream data

If you visit any of our web sites, data are transmitted from your browser to our server. These data allow us to optimize our services and improve your experience with our web sites and applications. These data are automatically collected and stored at us or at third parties that provide us services in the area of information technology. We in no case process these data so as to be attributable to a particular person. These data can include, in particular, the following:

  • visitor's IP address
  • date and time of visit
  • reference URL (the web site from which the visitor was directed to our web site)
  • subpages visited at our web site
  • information about the browser used (type and version of the browser, operating system, etc.)

2.1.2. Things you should know about cookies

First of all... what are cookies?

Cookies are small text files stored on your computer or mobile device. In that context, for practical reasons we use the term “cookies” as an umbrella term for the technical terms such as cookies, flash cookies, web beacons and JavaScript. They do not take much space and are automatically deleted once they expire. Validity of some cookies expires upon termination of your internet connection, while other cookies are saved for a certain limited period of time.

Secondly... why do we use cookies?

We use cookies so as to make your visit to our web site as comfortable as possible. Various types of cookies have different functions. Some cookies are used just to allow you to browse the site and display certain functions of the site. Other cookies inform us about the way you browse such as, for instance, if you have troubles finding what you are looking for, hence, thanks to these cookies we can improve our web site and ensure that your next visit to the site will be as pleasant as possible.

And then... what different types of cookies do we use?

  1. COMPULSORY COOKIES are necessary and assist you in orientation on the web site, allow you to browse the web site and display its certain functions.
  2. FUNCTIONAL COOKIES are used for a more user-friendly browsing.
  3. PERFORMANCE COOKIES help us to understand shopping behaviour of our visitors. Thanks to them we can continuously improve our web site to allow even easier and more pleasurable browsing.
  4. INTERACTION COOKIES are used for the expressing of your opinion. We want to know your opinion about our products, our web site and about us in general. These cookies allow you to “like” our contents or recommend it at social networks.

2.2. Data you provide

In addition to the data collected automatically, we also process data you have provided to us. These data include (but not limited to) the following:

  • Your contact data, including your first name and surname, address, e-mail address and possibly also your phone number. We need your e-mail address and (possibly) also your phone number to contact you regarding questions or information;
  • If you contact Sales Department, details about your communication with the Sales Department and its history.

It applies to all these data that the relevant information was provided by you voluntarily. We use this information for the purposes described in the document Information about Personal Data Processing.

We will use your contact data, especially your e-mail address for the purpose of direct marketing relating to the goods or services of J&T REAL ESTATE. J&T REAL ESTATE also promotes goods and services of companies to which it provides business consultancy and mediation on the basis of a contract. By providing your contact data, you agree with the use of these data for direct marketing purposes. You can anytime revoke your consent.

3. How do we use collected data?

We will use your data solely for the purposes connected with your queries and bookings.

If you provide your data to us in connection with a promotional event, event, (mobile) application, etc., we can send you e-mails or other messages about the services you have requested.

If you contact Sales Department, we will use your personal data (including your history of such contacts) to process your request and provide you the best service possible.

If you provide your data in connection with some event, product or service, we will inform you about similar products and services. We can also contact you to get your feed-back as regards your satisfaction, products or services. In the case of an unfinished shopping process, we will send you a reminder. You can anytime unsubscribe from mailing of such notifications free of charge, by clicking on the link in the relevant e-mail or other link (for details see Section 5 below).

We can contact you with the use of the contact data you have provided (including regular mail, e-mail, text message, phone or by any other electronic means) for marketing or promotional purposes or for the purpose of J&T REAL ESTATE customers opinion poll. That includes, for example, information about products or regular newsletters of the company. In order for us to provide you with information which could be of a particular interest for your, your clicks on newsletters and opening of single results, browsing behaviour (web tracking), types of newsletters you receive, your participation in promotion campaigns and events, interaction with miCoach and your use of (mobile) applications will be evaluated, analysed and used for the above-mentioned purposes. In this Section 5, you can find information about your rights, for instance, how to download your consent to the use of data or how to correct your data.

4. Disclosure of information

One of our main principles is that we will treat your personal data very attentively and we will keep them confidential. We will not transmit your data to third parties. Your data can only be provided to third parties if required so by law. We can transmit you data to other companies of J&T REAL ESTATE if it is compliant with the valid laws.

We can do so by means of service providers or data processors who act on behalf of J&T REAL ESTATE or its companies. These services may include hosting and maintenance services, analytical services, e-mailing services. These third parties will have access to those personal data which they need for the performance of the particular service. Service providers and data processors are bound on the basis of a contract to handle such information with strict confidentiality. They are also forbidden, on the basis of a contract, to use these data for any other purposes that those required in relation to their obligations. We apply all necessary measures to guarantee that our service providers and processors working on behalf of J&T REAL ESTATE or its companies will protect confidentiality of your data. In certain cases, we can provide our partners with non-personal data in anonymous form. Such non-personal data include, for instance, information about the number of visitors to our web sites or (mobile) application during a certain period of time. The information is usually only released in a “summary” form.

5. Your rights

If you provide us with your data by means of our web site or any other channel, you do so on an absolutely voluntary basis. Since transparency and fair play are of a great importance to use, we offer several options (depending on the particular circumstances) in order to help you to keep control over your data. These options also include, for instance, displaying and modifying of your data in online regime. Another option we offer is cancellation of subscription to our services.

5.1 The right to object and cancel subscription

E-mails we send to you and which also include, for instance, a newsletter or any other marketing contents, always contain the option to cancel the subscription to such e-mails – you just need to follow the instructions provided in the given e-mail. If you no longer wish to receive our e-mails, just click of the cancel subscription link and we will immediately stop sending of these e-mails.

5.2. The right to request information

You have the right to be anytime informed about the data we store in connection with you, about their origin and recipients, and also about the purpose for which they are stored. Information about the stored data can be obtained by means of contact data referred to in Contact data below.

5.3. The right to request rectification

You have the right to request rectification, supplementation or blocking of data we keep about you. Not later than within 30 days following receipt of your request, we will inform you of the extent in which will satisfy your request. If we do not satisfy your request for whatsoever reasons, we will inform you of these reasons.

6. Information security and data integrity

We also take appropriate technical and organizational measures to protect data against accidental or unlawful destruction, loss, modification, unauthorized use, disclosure or access, in particular, if the processing includes data transmission over network, and against any other unlawful forms of processing and misuse.

7. Social networks

Our web site and (mobile) applications offer the Social Plug-in functionality connected with various social networks. If you choose to interact with a social network, your activity on our web site or (mobile) application will also be available to the social networks such as Facebook and Twitter.

If you are signed in to some of these social networks during your visit to our web site or (mobile) application, the social network can add the information to your profile. If you use some plug-ins for social networks, the information will be sent to the social network. If you do not wish such data transfer, sign out from your account at the social network before you visit our web site or (mobile) applications.

We cannot influence the transmission and collection of data by means of plug-ins for social networks. We, therefore, advise you to study the privacy principles followed by these social networks to obtain detailed information about the collection and transmission of personal data and about your rights and how to ensure adequate privacy settings.

8. Geo-location services

In some of our (mobile) applications, we offer the use of location services such as, for instance, Google Maps and Bing Maps. If you use these (mobile) applications, they can obtain information about your current location (for instance, GPS signals sent by mobile device) or information that can be used to detect your current location. In general, you can activate or deactivate location services on your device or in browser settings.

9. Re-routing technology

Our web site and (mobile) applications use routing technology. That allows us to display our adverts on partner sites to our visitors who already showed their interest in our business and products in the past. We believe that displaying of personalized advertising contents based on interest of customers is more attractive for them than adverts without any personal connection.

We also cooperate with other companies that use this technology in order to display adverts on the Internet on our behalf. These companies can collect information about visits to our web site or (mobile) applications and also about your interaction with our communication, including advertisements.
